Pursuant to Articles 59(d) and (e) of the Italian Consumer Code (Legislative Decree 206/2005), the right of withdrawal does not apply to food products delivered with their regular shelf life, as the characteristics and quality of these products may be affected, even due to improper storage after delivery.
The products sold by Holi Grain S.R.L.S. are food items, packaged in sealed containers and intended for consumption within a specific period. These products may deteriorate or expire quickly and, for hygiene and consumer health protection reasons, cannot be returned once delivered.
Therefore, the right of withdrawal does not apply to food products purchased through our website.
Exclusions to the Consumer’s Right of Withdrawal
(Article 59 of the Italian Consumer Code – Legislative Decree 206/2005)
Generally, under Articles 52 et seq. of the Consumer Code, consumers have the right to withdraw from a purchase within 14 (fourteen) days of receiving the products, without providing a reason.
However, the right of withdrawal is excluded in the cases provided for in Article 59 of the Consumer Code:
Letter d): supply of goods that are likely to deteriorate or expire quickly;
Letter e): supply of sealed goods that cannot be returned for hygiene or health protection reasons and that have been opened after delivery.
These cases apply to all food products sold by Holi Grain S.R.L.S.
This exclusion aims to prevent situations such as:
alteration or deterioration of products;
damage or tampering of products;
storage not compliant with the producer’s instructions;
circumstances that could indirectly pose a risk to health or food safety.
